Terms of use

These terms of use govern your access to and use of Oligo Analytics. By using the platform you agree to these terms.

1. Acceptance of these Terms

You must be at least 18 years old and legally able to enter into a contract to use the Service. If you use the Service on behalf of a clinic, practice or other organization, you represent that you are authorized to bind that organization, and "you" refers to both you and that organization.

If you do not agree with any part of these Terms, you must not use the Service. We may update these Terms from time to time; material changes will be notified in advance, and continued use after the effective date constitutes acceptance.

2. Description of the Service

Oligo Analytics is a wellness and functional-health software platform for practitioners, operated by Aurea Medtech. The Service lets an authorized practitioner upload a mineral exam (an oligo-element / mineralogram analysis) and receive an AI-generated wellness evaluation organized across four axes:

• Detox: detoxification capacity and oxidative load insights.
• Hormonal: hormonal cofactor balance, including copper-to-zinc relationships and neuroendocrine signals.
• Energy: energy cofactors, mitochondrial and metabolic-load signals.
• Antiaging: redox balance, silicon and tissue-level wellness signals.

Each axis returns a score, activated cascades and general wellness recommendations. The Service also provides patient management, exam management and AI-generated narratives. Outputs are informational and educational in nature.

3. Wellness disclaimer and no medical advice

This Section is fundamental to your use of the Service. By using Oligo Analytics you acknowledge and agree that:

• The Service provides wellness insights only. It does not provide a medical diagnosis, and no output should be read as a statement that any disease, condition, injury or deficiency is present or absent.
• The Service does not prescribe, recommend or replace any medication, treatment, therapy or clinical procedure.
• AI-generated content may contain inaccuracies or omissions and must always be reviewed and contextualized by a qualified healthcare professional using their own independent judgment and the full clinical picture of the individual.
• Nothing in the Service creates a doctor-patient relationship between Oligo Analytics and any patient, and Oligo Analytics does not practice medicine.
• Individuals should never disregard, delay or discontinue professional medical care because of any information obtained through the Service, and any health decision remains the sole responsibility of the treating professional and the individual.

The Service is intended for use by trained practitioners as a supporting tool alongside, never in place of, appropriate clinical assessment.

4. Accounts and security

To use most features you must create an account. You agree to provide accurate information, keep it up to date and keep your credentials confidential. You are responsible for all activity under your account. You must notify us promptly at the contact below if you suspect any unauthorized access. We may suspend or disable accounts that appear compromised or that violate these Terms.

5. Acceptable use

You agree not to, and not to allow any third party to:

• use the Service for any unlawful purpose or in violation of any applicable health, data-protection or professional-conduct regulation;
• upload data of any individual without a valid legal basis and, where required, that individual's informed consent;
• present AI outputs to patients as a diagnosis, prescription or clinical guarantee;
• reverse engineer, scrape, resell, sublicense or attempt to derive the underlying models or source code of the Service;
• interfere with, overload or attempt to gain unauthorized access to the Service or its infrastructure;
• upload malicious code or content that infringes the rights of others.

6. Intellectual property

The Service, including its software, models, interfaces, text, graphics and branding, is owned by Oligo Analytics or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during your subscription. You retain ownership of the patient and exam data you upload; you grant us a limited license to process that data solely to provide and improve the Service in accordance with our Privacy Policy.

7. Third-party services

The Service relies on third-party providers, including AI processing providers and payment processors. Your use of those integrated services may also be subject to their own terms. We are not responsible for the acts or omissions of third-party providers beyond our reasonable control.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that any output is complete, accurate or suitable for any particular clinical decision.

9. Limitation of liability

To the maximum extent permitted by law, Oligo Analytics and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or health outcomes, arising out of or related to your use of, or inability to use, the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months preceding the event giving rise to the claim.

10. Termination

You may stop using the Service and close your account at any time, subject to the Subscription Agreement. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or its users. On termination, your license ends and you must stop using the Service; certain provisions (including Sections 3, 6, 8, 9 and 12) survive termination. Data handling on termination is described in our Privacy Policy.

11. Changes to the Service and Terms

We continuously improve the Service and may add, modify or discontinue features. We may revise these Terms; where changes are material, we will provide reasonable notice. If you do not agree with the updated Terms, you must stop using the Service.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Oligo Analytics is established, without regard to conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, unless mandatory consumer-protection law grants you rights in your place of residence.
